Standard Working Hours

Overtime Pay

For overtime on a regular work day, overtime pay is at 1.5 times the hourly wage.

For overtime on a rest day, public holiday or annual leave day, the rate is:

Normal working hours on a holiday: Monthly employee pay one time the normal hourly wage / and daily employee pay two times the normal hourly wage.

Overtime hours on a holiday: 3 times the normal hourly wage.

Public Holidays

There are at least 13 public holidays in Thailand.

 

Annual Leave

Minimum 6 days per year.

After employees have worked continuously for one year, they are entitled to six working days of paid leave. Employees who have worked for less than one year are entitled to paid annual leave according to their working years. Annual leave is not allowed during the probation period. Employees must give their employer at least 3 days’ notice before taking leave.The Employee must give the Employer at least 3 days' notice before taking a vacation.Subject to immediate manager's permission.

 

Sick Leave

Employees shall be entitled to take medical leave with pay to the extent of actual illness, but only for a maximum of thirty (30) working days per year.

Sick leave of 3 days or more requires a certificate from a first-class doctor or an official medical institution.

 

Maternity Leave

98 days.

Women are entitled to 98 days of maternity leave (including leave for prenatal check-ups before childbirth and public holidays in between). During maternity leave, the employer must pay the female employee on maternity leave the full salary for the first 45 days, and the subsequent employee may receive a subsidy from the social security department for up to 90 days at 50% of her usual basic salary, capped at 15,000 baht per month, and 15,000 baht for any excess.

 

Personal Leave.

The employee is entitled to take casual leave not exceeding 3 days per year with pay.

Labor contracts are divided into fixed-term contracts and permanent contracts.

 

Probation Period 

A fixed-term contract cannot specify a probation period, otherwise it will be judged as an indefinite contract.

The probation period of permanent contract cannot exceed 119 days at most.

Fixed-term Contract

A 30-day notice period is required for employees who leave during the probationary period. There is no notice period for employees who are dismissed.

For official employees, the notice period for resignation is 30 days and may not exceed 90 days; Employees who are dismissed, the notice period is usually after the notice is issued and one payroll cycle, which is generally not less than 30 days.

 

Permanent Contract

For probation period, the notice period for employee resignation is 30 days, and there is no notice period for dismissal.
